Reason for retiring policy
The state constitution sets limits on the use of trunk highway funds and the Office of Chief Counsel reviews proposed uses of trunk highway funds from a legal perspective as the need arises. Many factors must be considered when determining whether trunk highway funds may be used for public transit that cannot be easily delineated in a policy. The Office of Chief Counsel reviews these factors on a case-by-case basis. Because the agency relies on the Office of Chief Counsel to provide analysis and recommendations about proposed uses of trunk highway funds, the policy is unnecessary.
